Terms of Service for Pixie Color: Paint by Number

1. Introduction

These Terms of Service ("Terms") govern your use of the Pixie Color: Paint by Number mobile application (the "App") owned and operated by EFUN PTE. LTD. ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms and to comply with all applicable laws and regulations. If you do not agree with these Terms, you may not access or use the App.

2. User Accounts

• Eligibility: You must be at least 13 years old to use the App. If you are under this age, you may only use the App with parental consent.
• Account Registration: You may need to create an account to access certain features of the App. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
• Account Termination: We may terminate your account at any time for any reason, including but not limited to your breach of these Terms.

3. User Conduct

• Prohibited Activities: You may not use the App to engage in any illegal, harmful, or offensive activities. This includes, but is not limited to, harassment, spamming, and unauthorized access to the App or other users' accounts.
• Content Restrictions: If the App allows you to create or share content, you must ensure that your content does not violate any applicable laws or these Terms.
• Respect for Others: You must treat other users of the App with respect and courtesy.

4. Intellectual Property

• App Ownership: The App and all its content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.
• User Content: You retain ownership of any content you create within the App. However, by submitting content, you grant us a non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purposes of operating and improving the App.
• Feedback: Any feedback, suggestions, or ideas you provide to us about the App are considered non-confidential and we may use them without restriction.

5. Disclaimers and Limitations of Liability

• Disclaimer of Warranties: The App is provided "as is" and without any warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure.
• Limitation of Liability: To the fullest extent permitted by law, we will not be liable for any damages of any kind arising from your use of the App, including but not limited to direct, indirect, incidental, consequential, or punitive damages.
• Indemnification: You agree to indemnify and hold us harmless from any claims, losses, or damages arising out of your use of the App or your breach of these Terms.

6. Payments and Refunds

• Payment Terms: If the App offers in-app purchases or subscriptions, you agree to pay all applicable fees.
• All purchases and redemptions of Virtual Items made through your Use are final and non-refundable.

7. Third-Party Services

The App may contain links to third-party websites or services. We are not responsible for the content or privacy practices of these third-party services.

8. Dispute Resolution

• Governing Law: These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.
• Dispute Resolution Process: Please read this section carefully. It may significantly affect your legal rights, including your right to file a lawsuit in court. All disputes arising out of or related to these Terms of Use or any aspect of the relationship between you and us, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, will be resolved through final and binding arbitration before a neutral arbitrator instead of in a court by a judge or jury, and you agree that the company and you are each waiving the right to sue in court and to have a trial by a jury. You agree that any arbitration will take place on an individual basis; class arbitrations and class actions are not permitted, and you are agreeing to give up the ability to participate in a class action.

We may update these Terms from time to time. We will post any changes on this page and notify you through the App or via email. Your continued use of the App after the changes become effective constitutes your acceptance of the revised Terms.
